Delhi CM Arvind Kejriwal has faced yet another massive shock as the Election Commission has disqualified 20 MLAs of the Aam Aadmi Party(AAP), this noon, for holding ‘office of profit’. The recommendation of the EC will now go to the President of India, Mr Ram Nath Kovind for his approval.
Why were the 20 AAP MLAs disqualified?
“Section 15 of the government of NCT of Delhi Act, 1991 says a person shall not remain an MLA if he or she holds any office of profit under the Centre or government of a state or UT. The legislator can escape disqualification only if the office is declared by law made by Parliament, state legislature or UT as a post that does not attract loss of membership”.
But Kejriwal violated the law by appointing his MLAs as “parliamentary secretaries”. A petition filed by Delhi lawyer Prashant Patel sought the disqualification of 20 MLAs for allegedly holding an ‘office of profit’ as parliamentary secretaries.
The MLAs’ pleas that the case against them be dropped were rejected by the Election Commission in June 2017. But, the proceedings were dropped only against on MLA Jarnail Singh after he resigned as the Rajouri Garden MLA to contest the Punjab Assembly polls in February 2017.
Mr Arvind Kejriwal must resign immediately!
Perhaps, for the first time in the history of Delhi, this incident has taken place. The citizens of Delhi are embarrassed after the decision of Election Commission so Mr Kejriwal must take moral responsibility and resign from his post.
This is a huge moral defeat to Arvind Kejriwal. “Disqualification of 20 AAP MLAs is a huge moral defeat for CM Arvind Kejriwal. It has put his leadership in peril. He must resign on ethical grounds”, said Vijender Gupta, Ex-Delhi BJP President.

By-elections very soon! Will BJP form a government?
Altogether, 20 AAP MLAs have been disqualified by the EC, as a result, the Delhi may go to a by-election very soon. Now, the 20 MLAs are disqualified and the unity in AAP is no more as Kapil Mishra has moved out and even Kumar Vishwas was humiliated by Arvind Kejriwal, weeks ago.
In the 2015 Delhi Assembly Elections, the Aam Aadmi Party had secured 67 seats out of 70 seats. People of Delhi had elected AAP once again by believing that AAP will bring massive revolution. But AAP could do nothing other than scams and blame game.
For each and every failure, Arvind Kejriwal blamed PM Modi and due to this, there erupted massive anger in the minds of the public against Arvind Kejriwal. Now that Mr Kejriwal has faced a blow in the form of disqualification of 20 MLAs, the majority of the seats would be bagged by BJP in the upcoming by-polls.
Apart from this, if Kapil Mishra and Kumar Vishwas would join hands with PM Modi’s “developmental agenda” than BJP would be successful in forming the government in the national territory.
Mr Arvind Kejriwal is no more Mr Clean!
“20 AAP MLAs disqualified on the office of profit by Election Commission. Arvind Kejriwal, are you still Mr Clean. You rushed to Varanasi to contest against Narendra Modi? Where is Aam Aadmi Party’s integrity? Delhi to face mini polls in April?”

Even former President, Mr Pranab Mukherjee had slammed Arvind Kejriwal!
AAP had argued that this post did not qualify as an office of profit as there is no monetary benefit attached to it. The party’s efforts, however, got a jolt when President Pranab Mukherjee declined approval to the proposed amendment in June 2016 and the Delhi High Court set aside the order appointing the MLAs as parliamentary secretaries.
